| تحولات متنوع و روزافزون جامعه انسانی، منجر به ایجاد مسائل مختلفی شده و مطالعه مجزای آنها نیز نتوانسته کاهش احساس رضایت‌مندی از علم حقوق در مواجهه با این مسائل را چاره کند، جامعه با نوعی کج شدگی مدرن مواجه شده و خانواده‌ها در معرض امواج زندگی غربی نمی‌توانند به‌درستی به بقا و فرزند پروی و مدنی سازی آنها بپردازند، افزایش دعاوی، اطاله دادرسی‌ها و نیاز به آمارگیری از توزیع عدالت به‌جای آمارگیری از شمار پرونده‌ها، جمعیت بالای محکومان کیفری و زندانیان، هزینه‌های بالای دادرسی، گسسته شدن ارتباط دوسویه میان نظام حقوقی و تقویت هنجارها و افزوده شدن پی‌درپی بر مسئولیت‌ها دولت، از جمله اهم مسائل پیش روی نظام حقوقی بودند. بدین‌روی، تمهید نظریه عمومی و ابزار، برای صیانت از وجود روال طبیعی در پدیده‌های اجتماعی، به شیوه توصیفی، تحلیلی، تطبیقی و شیوه ابتکاری مهندسی، مورد پژوهش بنیادین قرار گرفت. تحت عنوان ارائه نظریه «مهندسی نظام حقوقی» با رویکرد حقوق خصوصی، این نتیجه حاصل شد که مقاصد شریعت بنیان‌های کلی نظام حقوقی و فلسفه وجودی نظام حقوقی، صیانت از عدالت تشریعی، به‌مثابه روال طبیعی (میزان)، نسبت به این بنیان‌ها است که رصد آن از طریق تابع چند هدفه و این صیانت از طریق مهندسی رفتارها و پیامدهای آنها، قابل انجام و در این میان نقش متقابل خانواده در مهندسی نظام حقوقی و نقش این مهندسی در تحکیم خانواده، برقرار است. | ||

| The diverse and increasing developments of human society have led to the creation of various issues, and studying them separately has not caused satisfaction with the law, society has a modern distortion and is exposed to Western waves, families aren't able to train their children also The increase in lawsuits, the delay of trials, the need to increase satisfaction and statistics on the distribution of justice, the inflation of criminal laws and prisoners, high costs of proceedings, inattention to relation of the legal system and the strengthening of norms and the successive increase in the government's responsibilities are among the issues that legal system is facing to them. Therefore, for presenting general theory and providing instruments to protect natural proceedings (justice), fundamentally researched in a descriptive, analytical, comparative, and innovative engineering method. These results were obtained under the title of presenting the theory of "legal system engineering" with the approach of private law, that the purposes of Sharia are the legal system foundation and to protect legislative justice, as a natural procedure (measure), about these foundations is its existence philosophy that It could be controlled through the Multiple Objective Decision making (MODM) function and this protection could be done through the engineering of behaviors and their payoff, in this regard, there is a mutual role between the strengthening of family and promoting the engineering of the legal system | ||
