چکیده

پس از تأسیس نظام جمهوری اسلامی و متأثر از فضای دینی، پوشش و کیفیت آن در ایران به عنوان یک مسئلة‌ عمومی شناخته شده و قوانین و سیاست‌های مختلفی در راستای ترویج و تثبیت پوشش اسلامی در اداره‌ها و اماکن دولتی و سپس در اماکن عمومی به تصویب رسید. در میان قوانین گوناگون حوزة پوشش، قانون ساماندهی مد و لباس مجلس شورای اسلامی، اولین قانونی است که به طور مستقیم به بحث مد و لباس توجه ویژه داشته است.
در این نوشتار با بهره‌گیری از روش کیفی (سندپژوهی و مصاحبه)، فرایند سیاست‌گذاری این قانون، بر اساس مدل فرایندی تحلیل شده و مورد ارزیابی قرار گرفته است. بهره‌گیری از اسناد و گزارش‌های موجود و مصاحبه با کارشناسان و دست‌اندرکاران این مهم در چارچوب فرایند سیاست‌گذاری (تعیین مسأله، شناسایی راه‌حل، تصمیم‌گیری، اجرا و ارزیابی) ما را به این نتیجه رساند که بخش عمده‌ای از ماده‌های قانون فوق اجرایی نشده و یا به صورت ناقص اجرا شده است. همچنین این قانون، در عین برخورداری از نقاط قوتی از قبیل وجود رویکرد حمایتی، تشویقی و ایجابی، بسیج تمامی دستگاه‌های مرتبط و... نقاط ضعفی همچون عدم طرح ساختاری فراتشکیلاتی برای کارگروه ساماندهی مد و لباس، عدم تخصیص اعتبار و بودجه کافی و نادیده گرفتن بخش خصوصی و... دارد که مانع تسریع در اجرایی شدن قانون شده‌اند.

چکیده [English]

Once established, the Islamic Republic system recognized a specific dress code conforming with the overall Islamic lifestyle as a public issue, hence endeavoring to codify and promote the Islamic dress in both official and public domains. Among the related regulations, the Law on Organizing Costume and Fashion passed by Majlis is the first of its kind that deals with the issue both directly and indirectly.
In this article, by using a quality method (consulting documents and interviewing)the process of related policymaking has been examined on the basis of a process model. The results obtained through the above-mentioned method consisting of defining the problem, finding the solution, decision-making, execution and evaluation, show that a large part of the law ,either partially or totally, hasn't been implemented yet. In addition, this law next to its strong points such as positive and encouraging approach and mobilizing all related organizations has also some weak points, namely lacking in a supraorganizational structure for the responsible team and sufficient budjet, and overlooking the private sector which can hinder the timely implementation of the law.
